Tobacco Legislation WatchAPRIL 20061. SMOKING IN PUBLIC PLACES GOVERNMENT ACTION Smoking in Public Places is being addressed separately by each country within the United Kingdom. The current status is as follows: ENGLAND Following the introduction of the Health Bill to Parliament on 27/10/05 the House of Commons voted by an overwhelming majority for a total ban with no exemptions in the hospitality sector. The Bill is currently in the House of Lords but, following the size of the Commons vote, any material amendment is considered unlikely. A significant amount of detail is yet to be confirmed and clarified in the Regulations which are expected for Consultation in May/June, and implementation is now planned for Summer 2007. The Association of Independent Specialist Tobacconists (AITS), in conjunction with the Imported Tobacco Products Advisory Council (ITPAC) and Hunters & Frankau, has focused its efforts on securing exemptions for smoking to be allowed to continue, in the interests of product tasting and testing, in Specialist Tobacconists qualifying under the Tobacco Advertising and Promotion Act 2002 (ie: if 50% or more of your sales consist of cigars, pipe tobacco, snuff and smokers’ accessories). This campaign has been pursued during each stage of the Bill’s passage through Parliament, including a widespread card/Internet petition directed at individual MPs, and also recent engagement with the Department of Health in advance of the preparation of the draft Regulations.
