Beyond the ban

As indoor smoking is about to be banned in all licensed premises across the United Kingdom, we look at how to get to grips with some of the challenges the ban creates.

It has been a long impending cloud over the industry and licensed premises, but come July 1st smoking in all licensed premises (and workplaces) across the country will be banned.

Despite substantial pressure from bodies such as the Imported Tobacco Products Advisory Council (ITPAC) the ban comes into force in England on July 1st, following the bans in Wales and Northern Ireland during April.

What hope there had been during the consultation period the year before last that there would be exemptions for certain licensed premises has been thwarted.

Nevertheless the Association of Independent Specialist Tobacconists (AITS), in partnership with ITPAC and fronted by Hunters & Frankau’s Simon Chase, battled to secure exemptions for limited pipe tobacco and cigar sampling to be allowed to continue, in the interests of product tasting and testing, in specialist tobacconists shops.

The current estimate is that there are 45 specialist shops in England as defined by the Tobacco Advertising and Promotion Act 2002.

This states that a specialist shop qualifies where more than half the sales derive from cigars, snuff, pipe tobaccos and smoking accessories.

The campaign highlighted the plight of shops at each stage of the Health Bill’s passage through Parliament, and specialist tobacconists encouraged their customers to join a widespread card and internet petition backing the campaign directed at MPs.
