Tobacco Legislation Watch

Tobacco legislation is moving fast. But remember, whatever happens it remains legal to sell tobacco products. 1. EU LABELLING DIRECTIVE

Date to Watch: Thursday 30th September 2004
• This is the last day it will be legal to sell cigar packs without the new Health Warnings and batch codes.
• The same date applies to any cigar packs bearing names or descriptors such as ‘Mild’ or ‘Light’, which might suggest the product is less harmful to health. Check if you have any cigar packs with the old warnings or descriptors and put them on sale now.

Notes:
• Any wrapping of individual cigars or cigarillos (e.g. cellophane sleeves, aluminium tubes or cedar wraps) are excluded from the regulations and do not require the new Health Warnings.
• It is already illegal to sell any individual brand and size of cigar that has not had its ingredients submitted to the Department of Health on an annual basis. Check with your supplier that all the cigars you sell are registered.

2. TOBACCO ADVERTISING AND PROMOTION ACT 2002 (TAPA)

Except to the trade all advertising including direct mailing or emailing customers without their specific request each and every time, and free sampling of any tobacco product or promotion item is already illegal. So is any form of sponsorship with a few well-known exceptions

Still to come are regulations on what advertising will be permitted at point of sale everywhere (including websites) and in Specialist Tobacconists, as well as on brandsharing - that means the sale of non-tobacco products that have a tobacco product brand name and vice versa.
