EU Advertising Directive
The Government has announced that it intends to regulate advertising on websites...
EU Advertising Directive (2003/33/EC)
Date to watch : No later than 31st July 2005
The Government has announced that it intends to regulate advertising on websites through the new EU Directive on Tobacco Advertising, which is why there are no regulations for websites under TAPA.
The Government is under an obligation to implement the Directive by 31st July 2005.
Business-to-business, tobacco trade websites will be exempted from the regulations, and the Department of Health has confirmed that it does not intend to outlaw the sale of tobacco products to consumers on the Internet.
However it is unclear what, if anything, it will be permissible to say about a tobacco product on a website.
The Department of Health has agreed to meet the Imported Tobacco Products Advisory Council (ITPAC) and the Association of Independent Tobacco Specialists (AITS) in November to discuss this issue.
